A landlord's guide to Electrical Safety Standards

Ensuring the safety of tenants is a fundamental responsibility for landlords. This guide provides an overview of the Electrical Safety Standards required in the private rented sector, helping you to remain compliant.

As a landlord, it's essential to be aware of the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020, which came into force on 1st June 2020. These regulations apply to all tenancies, with few exceptions, and are designed to uphold the safety of tenants by ensuring all electrical wiring and fixed electrical installations are inspected and tested by a qualified person at least every five years.

Your responsibility as a landlord

The regulations specify that landlords must:

  • Ensure national standards for electrical safety are met. These are set out in the 18th edition of the 'Wiring Regulations', which are the technical standards for electrical installations
  • Have the property's electrical installations inspected and tested by a qualified and competent person at least every five years
  • Obtain a satisfactory report from the inspector, which includes the results of the inspection and test, and the date of the next inspection
  • Supply a copy of this report to each existing tenant within 28 days of the inspection and test
  • Supply a copy of the most recent report to any new tenant before they occupy the premises, and to any prospective tenant within 28 days of receiving a request for the report
  • Retain a copy of the report to give to the inspector and tester who will undertake the next inspection and test
  • Supply a copy to the local housing authority within 7 days of receiving a request for a copy

What happens if you don't comply?

Non-compliance with these regulations can result in the local housing authority imposing a financial penalty of up to £30,000. It's crucial to adhere to these standards not only to avoid penalties but to ensure the safety and wellbeing of your tenants.

  • Establish a regular schedule for electrical inspections and keep detailed records of all safety checks and repairs
  • Choose qualified electricians who are registered with a competent person scheme to carry out inspections and any necessary work
